Order reserved on Vijender Gupta's complaint against Dikshit

A Delhi court today reserved for August 31 its order on BJP leader Vijender Gupta's complaint against Chief Minister Sheila Dikshit for alleged misuse of government funds to the tune of Rs 22.56 crore for an advertisement campaign before the 2008 assembly polls.

Special judge Narottam Kaushal reserved his order on Gupta's complaint seeking registration of FIR against Dikshit and others for alleged criminal breach of trust (section 409 IPC), criminal misappropriation of public funds and criminal misconduct under provisions of the Prevention of Corruption Act.

The court also reserved its order on a similar complaint filed against Dikshit by RTI activist Vivek Garg.
 

During the day, the court heard arguments from ex-Delhi BJP chief Gupta's counsel Ajay Burman and Director of Prosecution B S Joon.

Gupta's counsel submitted that the two status reports filed by Delhi Police on his complaints have wrongly concluded that no offence is made out against Dikshit.

"My complaint gives them relevant information. I have also annexed the order of Delhi Lokayukta Justice Manmohan Sarin who had on May 22 indicted Dikshit for allegedly misusing government funds for carrying out an advertisement campaign with a 'political purpose' ahead of the last assembly polls.

"Even the Lokayukta, who has been the Chief Justice of the Delhi High Court, has held that the money needs to be reimbursed. The funds were not of the party or hers. What more is needed to move the state machinery for investigation," he said. When the Lokayukta has given the report, how can a SHO say no offence is made out?" the counsel asked.
