The Madras High Court bench today ordered notice to the CBI on a petition seeking a direction to file an Action Taken Report in the September 11 2011 police firing in Paramakudi during the death anniversary of Dalit leader Immanuel Sekar Memorial day) when six Dalits were killed.

Justices M Jeychandran and S Vydhyanathan directed CBI officials in Chennai to file their counter within four weeks.

Petitioner Guruvijayan Arumugam, BSP State Executive Member, submitted CBI had not taken any concrete action since Dec 23 2011, when Madras High Court handed over investigation to it and also despite many representations sent by him, urging them to make progress. This amounted to contempt of court, he contended.

Even for self-defence police should not have opened fire on Dalits, who had assembled only to pay homage, he said and demanded CBI take appropriate action against the police officials.

The petitioner said it seemed CBI officials were colluding with state police as they had 'suppressed' the case on the firing. Justice for the Dalits should not be delayed,as it amounted to denying them justice, he said.

Hence he sought a direction from the the court to CBI to file an ATR with respect to the firing incident and also to direct them to take action within a specific timeframe.
