Petition not to grant permission for processions on Babri

The Madras High Court today dismissed a petition seeking a direction not to grant permission to any Muslim association from taking out processions or any other event on Babri Masjid demolition day on December 6.

Justice M M Sundresh, before whom the petition filed by Hindu Munnetra Kazhagam general secretary K Gopinath came up, said "the petitioner does not have any vested right to insist that no permission can be granted to the Tamil Nadu Muslim Munnetra Kazhagam."

The petitioner submitted that TMMK has distributed pamphlets and invitations conjoining all Muslim associations in India to take out processions on December 6, 2015. Hoardings were being erected in various areas and "deadly weapons and unwanted slogans and photographs of the mosque destruction have been portrayed in the hoardings."
 

It also invited people from various communities to take part in the rally. Such exhibits would create a rift between members of different communities, the petitioner said, adding that police ought not to give permission for TMMK or any other association to take out a procession or hold any other event to mark Babri Masjid demolition.

The petitioner further contended that though a representation was sent on November 23, requesting authorities to remove the hoardings and urging them not to give permission to TMMK to take out processions on December 6, they had failed to take any action.

Justice Sundresh said "there is no contra material to come to the conclusion that the chief secretary and the DGP will not take into consideration the relevant materials. There is no material too to come to the conclusion that TMMK, if granted permission, would act contrary to the law. Looking from any angle, this court does not find any reason to entertain this petition. Dismissed".
