A Division Bench of the Madras High Court today dismissed a petition seeking a CBI probe into the recruitment of nurses in JIPMER in Puducherry, and said mere allegation was not a sound basis to order an enquiry.
"Vague and general allegations, unsupported by requisite particulars, do not provide a sound basis to conduct enquiry into their veracity. The allegation must be demonstrated either by admitted or proved facts and circumstances obtainable in a given case," the bench, comprising Justice N Paul Vasanthakumar and Justice R Mahadevan said, dismissing the petition of unsuccessful candidate P Thamizharasan.
Tamizharasan in his petition alleged that JIPMER called for applications for 22 vacancies in its March 30, 2013 notification. Another one in July, however, increased the number of vacant posts to 465.

The petitioner alleged 330 of 465 candidates selected were from Thiruvananthapuram. Though the exam was usually held in Puducherry, this time the centres were fixed in Chennai, Tiruchirappali, Tiruvananthapuram and Puducherry.
He alleged that the newly-appointed administrative officer at JIPMER was instrumental in including new centres and also that there were irregularities such as question paper leak.
JIPMER, in its counter, said 159 candidates were selected from Thiruvananthapuram and the charge levelled against the administrative officer was baseless.
Dismissing the petition, the bench pointed out that a similar petition filed by another person had already been dismissed with an observation that charges of mala fide must be specific and should be strictly proved.
