Petition seeking constitution of Lok Ayukata filed

A PIL seeking to direct Tamil Nadu government to comply with the Sec63 of the Lokpal and Lok Ayuktas Act 2013 and enact the Lokayukta act in the state assembly within a stipulated time as fixed by the High court has been filed before the Madurai bench ofthe Madras High court today.

The Petitioner K Gurunathan, submitted that it was mandatory for the state governments to form Lok Ayukta. It was also the duty of the state governments to enact the laws as specified in the Lokpal Lok Ayukta Act, he submitted.

Besides Centre had also ratified the United Nations Convention against corruption and it was bound to enact appropriate laws for taking necessary steps against corrupt Politicians and higher Officials.
 

The Indian parliament had enacted the act in 2013 itself with the objective of zero tolerance against corruption, he submitted.

Since a Central Act in this regard into force on January 1, 2014, Tamil Nadu state legislature was duty to bound to enact the Lok Ayukta act before Dec 2014.

The Central also had not constituted Lok Pal at the Central level to inquire into the corruption allegations against Central Ministers MPs,and Higher officials.

In the meanwhile the central government proposed to amend some provisions in the Main act and constituted a comittee headed by E M Sudarsana Natchiappan. Whenever the Parliament session commenced, the committee sought time to file its report before the Parliament to amend the act and the Parliament also granted time, he submitted.

The committee should have filed the report in the last session, but it neither filed its report nor sought extension of time.

It was the duty of the Union Law Secretary to see whether the Tamil Nadu government had complied with the act and formed the Lok ayuktha in the state,the Petitioner said.

The petition was been posted by Justices Manikumar and C T Selvam along with other petitions for constituting Lok Ayuktha in Tamil Nadu for hearing.
