PIL in HC for equal distribution of funds between govt, MCDs

A PIL has been filed in the Delhi High Court seeking direction for "equitable" distribution of funds between the city government and municipal corporations here to ensure financial independence and proper functioning of the civic bodies.

The plea, which is likely to be heard on April 8, was moved by an NGO for directions to Delhi government led by Arvind Kejriwal and Lieutenant Governor Najeeb Jung to "immediately release adequate funds" to the three municipal bodies to enable them to perform their functions.

"Issue direction to the Finance Commission of India to discharge its constitutional duty... And to take all necessary measures to augment the financial resources of the Respondent nos. 4 to 6 (South, East and North Delhi Municipal Corporations).
 

"Issue direction to Respondent nos.1 to 3 (Delhi government, Lieutenant Governor and finance commission of India) to duly discharge their constitutional duty and implement and enforce the provisions of the Constitution to ensure financial independence and freedom of the municipal bodies," the plea filed by advocate Anil K Aggarwal said.

It also said the court should "restrain" Delhi government and LG from interfering "with the constitutional functions and duties of the Finance Commission of Delhi and the Municipalities".

Recently, after safai karmacharis of the BJP-ruled Municipal Corporation went on a waste-dumping spree on roads in the national capital, the AAP government decided to stake claim on the municipal corporation.
