PIL on 2007 CD row: SC provides legal aid to petitioner

The Supreme Court today ordered that legal aid be provided to a social activist for pursuing a PIL seeking a probe into non-filing of the charge sheet in a case relating to alleged circulation of controversial CD in Lucknow in 2007.

"We know the facts and need assistance on Law," a bench comprising Chief Justice H L Dattu and Justice A K Sikri said.

It asked PIL petitioner Hans Raj Jain to approach the Legal Services Authority on November 10 for getting assistance of a lawyer.

"There is a report from the Registrar. He has not found you able to address the court," the bench said when Jain kept advancing arguments.
 

Jain, a social activist who has been filing PILs, has made Uttar Pradesh Police and the Election Commission as parties in his fresh plea and has sought a probe into non-filing of charge sheet against then BJP President Rajnath Singh, Lalji Tandon and others in the FIR lodged against them at Lucknow in 2007 for allegedly circulating controversial compact disc (CD) there.

It was alleged in the FIR that the CD contained "inflammatory campaign material" against against a particular community.

The poll panel had then directed that FIR be lodged against all those responsible for producing the CD, including those who acted in it and wrote its script and those involved in its release, distribution and display.
