PIL seeks direction to Chief Secy

: A PIL has been filed in the Madras High Court seeking a direction to Tamil Nadu Chief Secretary to constitute District Level Police Complaint Authority and State Level Police Complaint Authority, as per directions issued by the Supreme Court in September 2006.

Advocate G Alex Benziger referred to the September 22 2006, directing all state governments to constitute a state security commission, provide guidelines for selection and minimum tenure of DGP and guidelines for minimum tenure of IG of Police and other officers.

The Apex Court had also directed all states to set up Police Complaints Authority of state level and district level to look into complaints against police officers and to establish National Security Commission.
 

"But the same has not been constituted till date in spite of the specific time granted by the Supreme Court upto March 30, 2007," the PIL said.

Alleging irregularities on the part of police in some cases, Benziger contended that his representations to higher police authorities on this matter were not responded to.Hence the present petition.

"Had this Police Complaints Authority been constituted in compliance of the orders of the Supreme Court of India,I could have raised my grievance before the said Police Complaints Authority," he contended.

When the matter came up for hearing, the First Bench, comprising Acting Chief Justice Rajesh Kumar Agrawal and Justice N Paul Vasanthakumar, ordered issue of notice to Tamil Nadu Chief Secretary.
