The plea also questioned the subsequent extension of his tenure this April by another two years, while he was 61 and had ceased to be eligible for appointment as registrar when he was first appointed at the post.

A division bench of Acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw issued notice to the Delhi Lieutenant Governor, DTU (erstwhile Delhi College of Engineering) besides Registrar U K Worah and sought their replies by May 16.

The bench was hearing a plea by advocate G S Parwanda, an advocate, seeking an order setting aside Worah's appointment for the post of registrar on the ground that his age is above the prescribed age limit under the Delhi Technological University (first) Statutes.

The petitioner challenged the government's April 11, 2012 order extending his tenure as Registrar and said Worah is 63 year-old which is against the statute.

"Despite the patent and clear contravention of the statutory provisions of the eligibility, the term of Worah has been extended as Registrar of the university," the petitioner lawyer said.

The high court bench has listed May 16, as the next date of hearing the matter. PTI PNM RAX
