The tribunal asked the police commissioner and the driver of the Police Control Room vehicle to pay Rs 34,135 to North East Delhi resident Bano who was hit by a speeding PCR van in 2005.
"From the statement of the petitioner (Bano) and in view of the criminal case registered at police station Nand Nagri, it is clear that the woman sustained injuries in the accident which occurred on June 1, 2005 due to rash and negligent driving of the driver of the vehicle belonging to respondent no.2 (police commissioner)," MACT Presiding Officer Rakesh Kumar said.
The tribunal said the compensation of Rs 34,135 should be jointly and severally paid to the woman by the police chief and the driver of the PCR vehicle.
According to Bano, the incident took place on June 1, 2005 morning when she was going on foot towards Loni from her house in Chand Bagh.
She was hit by the speeding van, being driven rashly and negligently by its driver Dayanand, she said adding that due to the impact, she fell down and received grievous injuries.
The woman, who was working in a factory and was earning Rs 5,000 per month, said she has suffered permanent disability due to accident and has been rendered jobless.
The driver, however, said the accident took place due to Bano's negligence and she cannot take benefit of her own wrong act.
He said Bano, while crossing the road, suddenly turned backward and started running in opposite side and he tried to avoid the accident by applying brakes but the vehicle touched her due to which she sustained injuries.
