Powerloom worker gets three years jail in assault case

A 45-year-old powerloom worker has been sentenced to three years rigorous imprisonment by a court here on charges of assaulting his co-worker, whom his wife had married after their divorce, in 2012.

Additional sessions judge M M Walimohammed held accused Mohammed Baccha Ansari from Bhiwandi guilty on Saturday under section 326 (voluntarily causing grievous hurt by dangerous weapon) of the IPC and imposed a fine of Rs 500 on him.

In his submission, DGP R J Kadri told the court that the victim Ilias Karim Ansari (40) was the second husband of the wife of the accused.

But after the couple came together again as per Islamic Sharia (Halala Nikah), Karim used to frequent the woman which annoyed Mohammed.
 

On October 5, 2012 the accused slashed the throat of the victim with a knife.

Badly injured, Karim rushed to his relatives and could not talk but wrote the name of the accused in a piece of paper and informed that he had attacked him.

The prosecution batted that the case fell under section 307 (attempt to murder) of the IPC but the court based on the evidence on record held that it fell under section 326 of the IPC and convicted and sentenced the accused to three years jail.

As per Islamic Sharia, a couple cannot remarry after divrce until the ex-wife marries another man, to ensure that divorce is not taken lightly.

She cannot go back to the husband who has divorced her , unless she marries another person and who out of his own free divorces her.

This rule is given by the Shari'ah to reduce the occurrence of triple-talaq.
