Judge N K Sudhindra Rao directed Deputy Superintendent of Police, Lokayukta Bangalore Urban,H S Manjunath to investigate under section 156(3) CrPC into the complaint filed by S M Alex, a businessman, and submit report by October 20.
Alex had alleged that Sharma indulged in "misuse of power" for acquiring land belonging to Bangalore Development Authority and giving a "false declaration" about its value and taking up illegal constructions.
Alex had submitted that in 2010 Sharma had acquired over 10,200 sqft of land at Doddagubbi village under Bangalore Rural District in the jurisdiction of BDA when he was the IGP Planning, paying Rs 17 lakh from one Purushottam, a vendor, "much below the guidance value".
Though the land came under the BDA jurisdiction "no sanction or licence was obtained for acquiring it from the BDA and while declaring this property before the designated authority, he neither mentioned the survey number nor the exact location mainly to avoid stamp duty", he alleged.
"Sharma claims to have taken the licence from the Doddagubbi village panchayat which has no territorial jurisdiction to issue such a licence", Alex submitted, thus "misusing his power as police official to get an illegal sanction".
Sharma as the IG Planning and as the BMTF Chief "given a false declaration about the value of the land he had acquired, giving the value which was much less than the guidance value", Alex submitted.
On August 25, 2012 Sharma himself was issued notice by the BDA to stop the illegal construction, Alex pointed out.
There are four accused in the case: M Shrinivas (village accountant), R Nagaraj (Tahsildar), R P Sharma and Purushottham (vendor).
