A petition has been filed in the Madras High Court questioning the authority under which the Secretary of Puducherry Assembly was continuing in his post, even after his superannuation on July 31 this year.
When the matter came up for hearing, Justice D Hariparanthaman ordered issuing of notice to Puducherry Chief Secretary.
P Saravanan from Puducherry, in his quo warranto petition, challenged the continuation of R Anbalagan as Secretary of the Assembly and sought to know under what authority, the incumbent officer continued to work.

He submitted that Anbalagan was working as Deputy Commissioner of Central Excise for nearly 10 years and he was appointed to his present post on July 5, 2012, with additional charge.
Observing that the officer had attained superannuation on July 31 this year, the petitioner submitted that he cannot continue after that period as per the Central Government Fundamental Rules.
Under the rules, no extension shall be granted beyond the age of 60 except in special circumstances. No such special circumstance was mentioned in the appointment order of Anbalagan, he contended.
