R.O proceedings declaring AIADMK candidate as winner

An independent, who filed her nomination for the post of Mayor of Tirunelveli Corporation, today sought to quash proceedings of the Returning Officer, declaring AIADMK candidate Bhuvaneswari as being elected unopposed.

Justice T S Sivagnanam ordered notice to the Returning Officer and Tirunelveli District Collector, among others, and posted the case for hearing On September 16.

Syed Ali Fathima submitted that though she had filled her nomination paper correctly as per the electoral roll published by Election Commission of India and gave her EPIC ID Card number, the RO rejected her application on the 'flimsy ground' that her name was not in the Electoral Voters list-2014 as claimed by the person who proposed her nomination.
 

She pointed out that when she filed a petition against rejection of her nomination,seeking an urgent hearing,the High Court had directed her to move the petition on regular motion.

Since two other candidates withdrew from the contest, the RO immediately announced Bhurvaneswari was elected unopposed, she said and contended that the Returning Officer should have waited till the date of election for announcing the same.

She charged the Returning officer with purposefully rejecting her nomination with malafide intention, just to declare the AIADMK candidate as elected unopposed and prayed that the notification be quashed.
