Raj HC seeks explanation on cross border migration issue

Rajasthan High Court has asked Additional Director General (Human Rights) to appear before the court and explain as to why police failed to analyse the data of missing persons being involved in cross border migration since 2009.

The division bench was concerned with the fact that as per statistics and information a large number of missing persons from border region are minority youth who are becoming potent anti-national threat for the state and the country and are being trained as terrorists.

The order came on a habeas corpus petition filed by one Pooranmal Saini in this regard.

According to the official statistics filed in the high court, state police told the division bench comprising of Justices R S Chauhan and Virendra S Siradhana that the figure of missing person was 5,318 for year 2009-2012 which increased to 8,161 by April 2013.
 

The court expressed its deep concern over the fact that, "Even after the police was directed to analyse the data to see if such persons were crossing border only to be trained as anti-nationalist, no such analysis has been done by the police so far."

"The fact that youngmen from the border district are missing, should be a cause for concern, as chances are that they are being trained, only to be sent into our state and into our nation for causing havoc with lives of people. Despite clear directions of this court, the police is still sleeping over the entire issue," the bench said.

Pulling up the police for its "lackadaisical" approach, the court directed its ADG to produce district-wise data with regard to the missing persons from year 2009 to April, 2010 and tell about the steps taken by the civil rights wing to analyse the data.

The bench has also asked ADG to inform the court, by personally appearing in court on 31 May, about the obstacles and bottlenecks being fixed by him in strengthening his wing in the police.

"As half of the missing persons are women and this is sorry state of affair," the bench observed.
