Rape accused let off after girl's u-turn

A girl, who alleged that she was kidnapped and raped by her neighbour for nearly six months leading to her getting pregnant, made a u-turn before a Delhi court saying she was in love with the accused leading to his acquittal.

The court also pointed out that as per the prosecution's version, the girl was made to abort the child she had conceived as a result of being raped by the accused but the DNA of the accused did not match with the foetus.

"The prosecutrix (girl) denied all the allegations which have been made against the accused during the course of investigation and rather stated that she was in love with him and had accompanied him voluntarily and the physical relations between her and the accused were established with her consent.
 

"It may also be relevant to point out at this juncture that as per the report of the FSL, the DNA profiling of blood sample of accused was not found similar to foetus preserved at the time of medical termination of pregnancy of the prosecutrix," additional sessions judge Kaveri Baweja said, while acquitting 22-year-old central Delhi resident Javed.

The prosecution's version was that on October 2, 2011 the girl went missing and her father lodged a complaint in which he raised suspicion over Javed.

On March 3, 2012, the girl's family received information that she was seen at a nearby market and was recovered from there by her brother while Javed fled from the spot.

During her examination, the girl said Javed kidnapped and confined her in his house for months where he repeatedly established physical relations with her and even beat her if she objected.

The court was told that during the course of investigation, the girl's statement was recorded by a magistrate and on March 17, 2012, the girl wad admitted to DDU Hospital where she underwent an abortion under orders of the CWC concerned.

However, during her cross-examination, the girl deposed that as her parents objected to her marriage with the accused, she left her house and�went�with him and wants to continue to live with him.
