Rape case:Court rejects complaint agst private institute's CMD

A Delhi court has quashed a criminal complaint against the chairman-cum-managing director of a private management institute here for allegedly raping a woman employee in 2008, saying there was an unexplained delay on her part in approaching the police authorities.

The court's order came on a revision petition of the woman, a senior officer of the institute based in south Delhi's Vasant Kunj area, whose complaint against the CMD of the college was dismissed by a trial court in 2012.

Additional Sessions Judge Manoj Jain, while upholding the trial court's order, said, "Nothing has been explained as to why there was so much unexplained delay in filing the complaint to the police authorities. There is nothing on record to show as to why the complainant did not file her compliant at earliest possible opportunity."
 

The court noted that the last alleged incident occurred on December 3, 2008, and she had filed the complaint to the police on January 29, 2009, and said the allegations including that of rape, wrongful restraint and outraging modesty under IPC, were not substantiated as her "version was doubtful".

The sessions court also said there was no medical evidence to prove that she was raped.

"There is nothing on record to show that she had taken the remedial measures...There is no medical evidence on the record file to support her version to the effect that she was raped and molested by the accused as alleged," it said.

The woman had alleged that the then CMD of the institute used to send her flattering text messages and later on the pretext of a meeting late at night, raped her in a hotel room.

She had further alleged that she was given promotions and whenever she decided to quit the job, the CMD apologised to her in the fear of a police complaint. However, she finally left the job and lodged a complaint against him in January 2009, it said.

The plea claimed that she had also approached the Delhi Commission for Women in December 2008 and, then police, but no action was taken, hence, left with no other remedy, she filed this complaint.
