A consumer forum here has asked TDI Infrastructures Ltd to pay Rs 5.5 lakh to a man, who had booked a shop in its upcoming commercial project in Sonepat, for not providing him the documents related to his shop, while holding it guilty of "deficiency in service".
New Delhi District Consumer Disputes Redressal Forum, presided by C K Chaturvedi, asked the real estate firm to give the money to Delhi resident Vinod Kumar Kuchhal, noting that although the company had promised to complete the project in one year, it could not complete it even after three years.
"We found Opposite Party (construction company) is extremely negligent in executing the papers of allotment and demanding further instalments. It is promised by OP that the allotment of shop would be given within one year from the date of booking, but even after expiry of three years OP failed to execute the papers regarding allotment of shop.
"So holding OP guilty of deficiency in service, we direct it to pay Rs 4.5 (booking amount)...We further award Rs 1 lakh as compensation...," the forum's bench, also comprising its members S R Chaudhary, said.
Kuchhal had told the forum that he had booked a shop with the company by paying Rs 4.5 lakh and was allotted a shop, which was promised to be in the Commercial Plaza named AS-TDI, Park Street situated at Sonepat, Haryana.
At the time of allotment, the company had promised that the construction would be completed within one year and, thereafter, possession would be given within one year.
At the time of booking, it had also promised to demand further instalments after the execution of all papers containing terms and conditions, payment schedule etc.
However, when he requested for supply of documents, the real-estate company raised further demands on different dates.
Under these circumstances, he asked for cancellation of booking and refund of booking amount. Later, when the company did not refund him, he approached the forum.
The company, however, submitted that due to global economic shut down, it defaulted in making payments as per schedule and there was no deficiency on its part.
