Road mishap: Nearly Rs 15 L compensation for kin of victim

Family members of a 32-year-old man, who died after being hit by a rashly-driven tempo, have been awarded compensation of nearly Rs 15 lakh by a Motor Accident Claims Tribunal (MACT) here.

The tribunal directed Reliance General Insurance Co Ltd, insurer of the offending vehicle, to pay Rs 14,75,616 to Delhi resident Amrendra Kumar Gupta, who died in the mishap in September 2009.

"From the statement of prosecution witness 2 Ankush Goyal (eye witness) and in view of the criminal case record, it is proved that the deceased Amrendra Kumar Gupta sustained fatal injuries in the accident which occurred on September 29, 2009, due to rash and negligent driving of offending vehicle...By its driver," MACT presiding officer Kiran Bansal said.
 

"Award is passed directing respondent no 3, Reliance General Insurance Co Ltd to pay to the claimants/petitioners a sum of Rs 14,75,616," the tribunal said.

According to the petition, on September 29, 2009 at about 3:30 PM, Gupta was hit by a tempo, being driven in a rash and negligent manner in a northeast Delhi area, while he was on a bicycle.

Due to the impact, he fell down on the road and sustained fatal injuries.

Thereafter, the family members of Gupta filed a petition before the tribunal seeking the compensation.

They had claimed in the petition that Gupta was in business and was earning Rs 10,000 per month.

The driver and the owner of the offending vehicle, however, had initially denied the allegations and had stated that it was Gupta who had suddenly come in front of the tempo.

However, later they did not appear before the tribunal.
