Rs 7.46 lakh compensation for parents of road mishap victim

MACT Presiding Officer Arun Bhardwaj ordered ICICI Lombard General Insurance Company Ltd, with which the offending vehicle was insured, to pay the amount to the victim's family.

"Total compensation payable to the petitioners would be Rs 7,46,232...Insurance company has not proved any defence. Therefore, compensation is to be paid by the insurance company within 30 days," the tribunal said.

The tribunal awarded the compensation on a petition by the parents of late Santosh Sahni, who used to clean cars in several South-West Delhi's residential societies to earn his livelihood.

Sahni's parents told the court that on August 2, 2011, a rashly-driven motorcycle had hit their son, while he was going to clean and wash cars near Sector 11 at Dwarka here.

 

They added he was taken to Deen Dayal Upadhyay Hospital after the accident where he succumbed to his injuries.

Ashish Dagar, who was riding the offending motorcycle, had argued that the accident had not taken place due to his negligence, but due to a rashly-driven Santro car which hit his motorcycle from behind.

As a result of the collision, his bike had slipped due to which Sahni was injured, he said.

The presiding officer, however, dismissed Dagar's version saying if his bike was hit by the car, the back side of the motorcycle was bound to be damaged but it was not so.

The tribunal said only the front indicators were broken and there were scratches on the head light of the motorcycle but there was no damage to the back of the vehicle.
