Rs 76 L compensation for kin of businessman killed in accident

A motor accident claims tribunal (MACT) here has awarded over Rs 76 lakh to the family of a businessman who lost his life in a road accident in Bihar 11 years ago.

MACT Presiding Officer Amit Bansal asked the Oriental Insurance CompanyLimited, insurer of the truck that had hit north-west Delhi resident DevenderKumar's bike from behind killing him instantly, to pay Rs 76,22,770 to his family.

The tribunal noted that the truck was driven in a rash and negligent manner.

"The offending vehicle was being driven at a very high speed, which... prove on record that the offending vehicle was driven by the driver in rash and negligent manner," the tribunal observed.
 

The petition alleged that 39-year-old Mishra, while riding his bike through Muzaffarpur district in Bihar, was hit by a rash and negligently driven truck from behind which ran over his head and killed him instantaneously.

The truck driver, however, stated that he was driving diligently and the victim was responsible for the accident.

The tribunal also rejected the version of the insurance company that the accident took place due to the negligence of Mishra and asked it to deposit the amount within stipulated time.
