A bench of justices P Sathasivam and Ranjan Gogoi granted the time on the request of Additional Solicitor General Gourab Banerjee who sought adjournment of the matter for two weeks to enable the Centre file its report.
On July 9, the bench was informed by Banerjee that Fasih was in the custody of Saudi police and had submitted that the habeas corpus petition filed by his wife Nikhat Parveen has become infructuous.
Concurring that on account of the latest developments relating to the deportation plea made by India, the bench had, however, asked the ASG to make a written submission it on the issue.
Parveen had earlier moved habeas corpus petition in the apex court alleging that her husband was in the custody of Indian police.
The CBI had earlier issued a red corner notice for tracking Fasih.
An engineer by profession, 28-year old Fasih from Bihar was allegedly involved in the Chinnaswamy Stadium blast in Bangalore and the shooting incident near Jama Masjid in Delhi in 2010 and is wanted by both Delhi and Karnataka Police.
At the request of Karnataka and Delhi Police, CBI had asked the Interpol to issue a Red Corner Notice against Fasih, after which Saudi authorities have conveyed that he has been apprehended by them.
