Awarding the maintenance to the woman, the court said till the entire truth comes out, the husband is liable to maintain his wife.
"At this stage, till the entire truth is brought out by way of evidence, the estranged wife living separately is prima facie entitled to be maintained by her husband. This is so because in view of the allegation of cruelty. At this stage, it cannot be said that she has willingly left his company," Metropolitan Magistrate Monika Saroha said.
Asking the man to pay Rs 10,000 alimony to his wife per month, the court said as he has admitted that he was working as a principal with a private school, he must be earning at least Rs 30,000 per month.
"...The court presumes that even at that time the man who is now admittedly working as a principal with a private school must be earning at least Rs 30,000 per month from other sources and not Rs 4,000 (as averred by him ) which is half of the minimum wages prescribed by the Government of NCT of Delhi for skilled daily labours," it said.
