Schoolboy's death: Gurgaon court adjourns hearing to July 30

A sessions court here today deferred till July 30 the hearing on a case related to the killing of a seven-year-old boy at a private school in Bhondsi here.

The case was adjourned after the court was informed that a transfer petition was pending in the Punjab and Haryana High Court and the hearing was scheduled for July 26.

Advocate Sushil Tekriwal, lawyer for the seven-year-old victim, told PTI that Additional Sessions Judge Jasbir Singh Kundu has written a reference order to the District and Sessions Judge stating that the matter should be heard by the special CBI court in Panchkula due to jurisdictional issues.

 

The matter is now posted for hearing on July 30, to await the outcome of the CBI plea in the high court for transferring the case, he said.

"A further legal-technical complexity has arisen in the matter qua jurisdiction which is ultimately creating impediment in the expeditious trial of the entire case. CBI took a decision earlier and contended that Gurgaon district court has the jurisdiction and now the same CBI has filed transfer petition in high court for transfer of the case from Gurgaon to Panchkula court.

"It's frustrating but we will fight out the same. We have no issues whether case be tried at Gurgaon or Panchkula but the trial be concluded expeditiously. Also it's depressing to hear that CBI today also failed to file final charge sheet," Tekriwal said.

The 16-year-old student had challenged the December 20 order of the Juvenile Justice Board (JJB) that had held that the teenager would be tried as an adult in the murder case.

The CBI, in its charge sheet, had alleged that the teenager had murdered the student on September 8 last year in a bid to get school examinations postponed and a scheduled parent-teacher meeting cancelled.

The victim's body, with his throat slit, was found in the washroom of the school at the Bhondsi area here.

The juvenile board had passed the order based on the sociological, psychological and physiological reports of the Class 11 student.

Earlier, the court had barred the media from using the name of the 16-year-old juvenile accused in the case and asked it to use fictitious names instead.

While the seven-year-old victim was named "Prince" by the court, the juvenile accused was named "Bholu" and the school was referred to as "Vidyalaya".

The probe agency had earlier given a clean chit to school bus conductor Ashok Kumar, who was arrested by the Gurgaon Police, saying there was no evidence to prove his involvement in the crime.

The CBI had taken up the case from the Gurgaon police on September 22, following a nationwide uproar over the gruesome killing.
