Settlement between MoS Rathore and builder on cards: SC told

The Supreme Court was today told that there is a "ray of hope" of a settlement between Union Minister Rajyavardhan Singh Rathore and Parsvnath Developers regarding possession of a flat in Gurugram.

A bench headed by Justice Dipak Misra was informed by a committee of lawyers that negotiations were going on and there were chances that the parties would arrive at a settlement.

The bench, also comprising Justices A M Khanwilkar and M M Shantanagoudar, posted the matter for further hearing on March 27 while noting that the parties have said "there is a ray of hope of settlement" between them.
 

The counsel for the committee of lawyers had earlier told the bench that the draft of settlement has been exchanged by both the parties and negotiations were nearing completion.

A two-member committee of lawyers was appointed by the apex court to look into Rathore's allegations that the flat given to him by the developer was uninhabitable.

The apex court had on December 14 last year asked Rathore to sit with the representatives of the builder and settle the dispute amicably regarding possession of the flat in Gurugram.

It had also asked the realty firm to remove deficiences in the flat as pointed out by Rathore and the committee, that had visited the site, and hand it over to the minister.

Rathore had booked the flat in Parsvnath's Exotica project in Gurugram in 2006 and had paid around Rs 70 lakh for it. The firm was to deliver the flat in 2008-09.

In January this year, the National Consumer Disputes Redressal Commission had directed the builder to refund the principal amount with interest and compensate Rathore.

The apex court had on October 21 last year directed Parsvnath Developers to hand over possession of the flat to Rathore in two days, saying he should not pay any more amount to the builder.
