A court here today allowed the bail plea of Babu Khan alias Nasruddin in the Shrawan Sahu murder case.

Judicial magistrate Vineeta Singh granted him bail as the CBI could not complete its investigation and file charge sheet against him within 90 days of his arrest. Khan was taken into judicial custody on March 3.

In the bail application on June 2, his lawyer submitted that Khan was entitled to bail because no charge sheet was forwarded against him within statutory period of 90 days.

The CBI had filed charge sheet against Aqil Ansari, Satyam Patel alias Roki, Ajai Patel, Rohit Mishra and Vivek Verma on May 9 but the name of Khan was not in it.

The CBI told the court that probe was pending against Khan.

At this, the court directed that Khan be released from jail on his furnishing a bail bond and surety.

On February 1, motorcycle-borne assailants had gunned down Shrawan outside his house in Sadatganj area. Shrawan was pursuing a court case against Aqeel, a listed criminal from Thakurganj area.

Aqeel had killed Shrawan's son Ayush in October 2013 over a tiff at a beer bar in Thakurganj.

As name of the three city policemen, who allegedly supported Aqeel clandestinely, had cropped up in the entire episode, the high court directed CBI to take over the case. The agency took over the case in first week of April.
