The court acquitted them as the CBI failed to examine the persons whose telephone lines were misused.

According to CBI counsel, Firoz Hussain and his brother Irfan were running illegal telephone exchange from the house of one Pratibha Shah in Mumbai in 1992.

They were allegedly helped by three officials of Coloba Telephone exchange -- Bhupendra Patel, Prakash Bhoghle and Surendra Tiwari.

All the accused were arrested under the Prevention of Corruption Act and CBI lawyer examined 27 of them.

Defence lawyer advocate Wahab Khan, however, argued that CBI had failed to examine the persons whose lines were allegedly misused, and also failed to ascertain the monetary loss.

The court acquitted all the accused, giving them benefit of doubt.
