Spanish woman rape case: Examination of witnesses completed

The prosecution today completed examination of witnesses in connection with the alleged rape of a 27-year-old Spanish musician at her rented flat in suburban Bandra last year.

The court will now record the statement of the accused Mohammad Badshah, a history-sheeter.

The witnesses comprised doctors who examined the woman after the rape, police personnel, the watchman of the building who reportedly saw the accused shinning up the water pipe, among others.

"The recording of evidence is completed. From tomorrow, the court will record the statement of Mohammed Badshah under a provision of section 313 of the CrPC," said Special Public Prosecutor Ujjwal Nikam.
 

Under the provision, the accused is given a chance to explain the circumstances and allegations against him.

Police had filed a chargesheet in January this year against the accused for allegedly raping and robing the Spanish national.

According to prosecution, Ansari sneaked into the flat of the woman, who was staying alone, through an open window and allegedly raped her after robbing her at knife point. He was arrested on November 6 last year.

Ansari had been booked under sections 452 (house trespass), 392 (robbery), 376 (rape), 377 (unnatural sex) and 506 (criminal intimidation) of Indian Penal Code.

The victim was staying as a tenant in a flat on the third floor of a building at Perry Cross Road in up scale suburban Bandra.

Earlier, Ansari had been arrested on October 27 last year in another case of robbery at the residence of actor Dino Morea. He was picked up from his shanty in Reay Road in this case and was later arrested.

He was released on bail but apparently took to crime again.
