: Madras High Court today vacated the stay on construction of a Road Over Bridge at Devathanam in Tiruchi Corporation limits,after Highways department submitted that funds for land acquired for it would be deposited in the Civil Court,which would decide who was entitled for the money.
Justice R Subbiah closed the petition filed by one Kannan, who contended that the lands acquired by the HD for the project belonged to him,as per court decree,and he had a patta for the same
He sought quashing of the notification issued by the HD that the land belonged to the Thayumanavaswamy temple and Dharmapura adheenam and also that he be compensated.

The Judge noted that Government had almost completed the project except for a small stretch of land due to the interim order granted by court. The project was in common interest. If there was dispute over the title, the competent civil court should be approached, he said.
Government had fairly come forward to deposit the money before the civil court. The Petitioner as well as the temple should approach the competent civil court and establish their title. Government should deposit the entire award amount in respect of the land in question within eight weeks from receipt of the order, the judge said.
