Janata Party President Subramanian Swamy's plea against Finance Minister P Chidambaram in the 1987 Hashimpura massacre in Uttar Pradesh was today dismissed by a Delhi court which said it cannot "transgress the path" when the trial is already on.
Sixteen PAC personnel are facing trial in the killing of 42 persons in Hashimpura area of UP's Meerut district.
"Applicant is stated to be a public spirited citizen who has taken note of the incident as a pogrom by the police at the behest of some political person and seeks this court to see the incident in the same view," Additional Sessions Judge Rakesh Siddhartha said.
Swamy had claimed in his plea that these PAC personnel had merely executed the orders of a senior person and the alleged role of Chidambaram, who was the Union Minister of State for Internal Security between 1986 and 1989, should be probed.
Ruling out Swamy's authority to move such an application, the court said, "It is imperative that locus standi of the applicant is determined before any other issue and as per the law, he has no locus and it is only the police who can move an application (for further probe)."
The court also said it could have ordered a further probe against any other person if any of the chargesheeted accused or any witness in the case would have mentioned him.
