Talks between MoS Rathore and builder almost complete: SC told

Negotiations between Union Minister Rajyavardhan Singh Rathore and Parsvnath Developers regarding possession of a flat is nearing completion, a panel of lawers told the Supreme Court today.

A bench headed by Justices Dipak Misra gave seven days to both the parties to arrive at a consensus and settle their dispute amicably.

The bench, also comprising Justices A M Khanwilkar and M M Shantanagoudar, was informed by the counsel for the committee of lawyers that the draft of settlement has been exchanged by both parties and negotiations are nearing completion.

It posted the matter for further hearing on February 27.

A two-member committee of lawyers was appointed by the apex court to look into Rathore's allegations that the flat given to him by the developer was uninhabitable.
 

On January 12, the court was informed that talks over settlement of disputes with regard to the possession of a flat between the minister and developers were underway.

The apex court had on December 14 asked Rathore to sit with the representatives of the builder and settle the dispute amicably regarding possession of the flat in Gurugram.

It had also asked the realty firm to remove deficiences in the flat as pointed out by Rathore and the committee, that had visited the site, and hand it over to the minister.

Rathore had booked the flat in Parsvnath's Exotica project in Gurugram in 2006 and paid around Rs 70 lakh for it. The firm was to deliver the flat in 2008-09.

In January this year, the National Consumer Disputes Redressal Commission had directed the builder to refund the principal amount with interest and compensate Rathore.

The apex court had on October 21 directed Parsvnath Developers to hand over possession of the flat to Rathore in two days, saying he should not pay any more amount to the builder.
