The submission was made by senior counsel for the EC in response to a petition by one K Sivakumar seeking a direction to Chief Election Commissioner, Tamil Nadu Director General of Police and others to enable all police personnel in the state to avail the postal ballot facility during elections in the state.
He produced a copy of the August 21 EC communication that it has decided to extend the facility to all police officials covered under the notification issued by the state government except to those on leave during the election period.
In view of the communication, a division bench comprising Chief Justice M Y Eqbal and Justice A Arumughaswamy disposed of the petition.
