Top cop assures appearance, NGT recalls bailable warrant

The National Green Tribunal (NGT) today recalled the bailable warrant it issued against the Commissioner of Delhi Police for not responding to the notice issued to him in a matter relating to alleged illegal construction in Central Ridge area by the trust managing the Birla Temple here.

A bench headed by NGT Chairperson Justice Swatanter Kumar directed that the bailable warrant against the police chief be not executed after the counsel, appearing for him, assured the Tribunal that someone will appear on his behalf during the proceedings in the matter.

"By this application, applicant (Commissioner, Delhi Police) seeks modification of our order of October 3, 2013 by which bailable warrant against the Commissioner of Police of Delhi have been issued.
 

"For the reasons stated in the application and the bonafides on the part of the applicant, we direct modification of the order to the extent it directs issuance of bailable warrant against said Respondent. Bailable warrant be not executed and the order of October 3, 2013 is recalled..," it said.

The NGT had on October 3 issued a bailable warrant against the Commissioner of Delhi Police as no one had appeared on his behalf despite issue of a notice in the matter.
