Metropolitan Magistrate Prashant Sharma acquitted South Delhi residents Amit Tomar and Arun of the charges of robbing complainant Usha Hari of her gold chain saying the case of the prosecution was not proved beyond reasonable doubt.

"Usha Hari, examined by the prosecution, was the material eye witness. She did not support the prosecution version.

"As the material witness is declared hostile and the rest of the witnesses are just the procedural witness therefore, no purpose will be served by calling them.

"I find that prosecution has failed to prove its case beyond reasonable doubt. Accordingly, accused persons are acquitted of the offences," the judge said.

According to the prosecution, the accused had snatched the gold chain of Usha near Mehrauli here in April 2011.

Usha, however, was unable to identify the accused during the trial. The accused, on the other hand had argued that they were innocent and had been falsely implicated in the case.
