Two get life term for murdering truck driver

Two men have been sentenced to life imprisonment by a Delhi court for murdering a truck driver and hiding his body before fleeing with the victim's goods-laden vehicle in January, 2006.

Additional Sessions Judge (ASJ) Reetesh Singh held accused Ram Yash, who was working as a helper with driver Shyam Kumar, and Madan Kumar guilty of the offences punishable under sections 302 (murder), 201 (destruction of evidence) and 34 (common intention) under the IPC and imposed a fine of Rs 30,000 each.

"It is proved that accused Ram Yash had motive and necessary intention to kill Shyam Kumar. It is also proved that due to this intention, he acted and.....Killed Shyam Kumar. Hence, by way of evidence, prosecution has proved this fact and intention to loot the goods loaded on the truck," the court said.
 

Madan was also held guilty of possessing stolen property.

The court, however, acquitted Ram and Madan of the charge of causing hurt in robbery and robbing the driver of his goods loaded truck with an attempt to cause his death.

In his order, the judge said it was proved that Ram was last seen with the victim and he had failed to explain as to what happened on the night of the incident.

The court said it was a fact that after his arrest, Madan led the police party to the place where the dead body was found and this proved that he had knowledge about it.

According to the prosecution, Ram and Madan murdered Shyam with a knife in his truck to rob the goods, mobile phone, Rs 1,200 cash, wrist watch and other articles.

The incident took place at Mathura Road here and a case was registered at New Friends Colony.
