Two lawyers, guilty of beating colleague, freed with warning

The court held the father-son duo guilty of voluntarily hurting and wrongfully restraining the complainant outside a court room where his matter was listed for hearing, but freed them showing leniency to them.

"In view of the fact that no previous involvement or conviction in any similar criminal case have been brought on record by the prosecution, in my considered opinion, lenient view can be taken against the convict persons.

"Considering the period of trial, age and physical health of the convicts, I deem it fit to release both the convicts after admonishing them under the provisions of the Probation of Offender Act, 1958 with a warning not to commit any such offence in future," Additional Chief Metropolitan Magistrate Kuldeep Narayan said.

 

According to the prosecution, the incident took place on August 20, 2007, when complainant advocate was waiting outside a courtroom in Karkardooma court complex here for beginning on the hearing of his case.

The two accused along with few other lawyers accosted him and began abusing him and beating him, said the prosecution adding even as he tried to escape from there, they caught hold of him and kicked and punched him.

The injured was taken to Dr Hedgewar Arogya Sansthan medical aide, while a criminal case was lodged by the police against the two, the prosecution said.

The accused had sought leniency saying they are practicing lawyers and had no criminal history.
