Two men sentenced to two months in jail, let off on probation

Additional Sessions Judge Pawan Kumar Jain let off West Delhi residents Ejaj Ahmed and Mohammad Fayaz on probation, setting aside a a magisterial court's order which had given them two months' prison term for assaulting their neighbour Bashir Ahmed.

The court had also imposed a fine of Rs 10,000 each on the convicts, payable as compensation to Bashir.

"I am of the considered opinion that ends of justice will be met, if both revisionists (Ejaj and Fayaz) be released on probation.

While releasing them "on probation of good conduct for a period of six months," the court asked them to deposit Rs 10,000 each as compensation with the trial court to be given to Bashir.

 

As per the prosecution case dating back to July 2005, Ejaj's minor son had misbehaved with Bashir's 12-year-old niece, in front of his house in West Delhi area.

When Bashir attempted to stop the boy, he started abusing him. Ejaj and Fayaz, meanwhile, reached the spot and started assaulting Bashir with bricks.

During the scuffle that ensued, Bashir's wife too had suffered injuries, the prosecution had said.
