Woman denied anticipatory bail for making casteist remarks

The Delhi High Court today rejected a woman's plea seeking anticipatory bail in a case registered against her for allegedly making casteist remarks against her neighbour.

Dismissing the plea of Pooja Jha, a resident of Sangam Vihar, Justice Sunita Gupta said, "So far as Pooja is concerned, there are clear allegations that she along with others addressed... In view of the clear allegations against her, she is not entitled to be released on anticipatory bail."

The court, however, allowed another plea of her relative Aarti Jha saying there are no allegations against her under the SC/ST (Prevention of Atrocities) Act.
 

"Petitioner Aarti Jha is ordered to be released on bail in the event of her arrest on furnishing a personal bond of Rs 15,000 with one surety of like amount to the satisfaction of the concerned SHO," the order said.

The court also directed Aarti to join investigation as and when required besides, asking her not to contact any prosecution witness or tamper with evidence.

According to the FIR against the Jhas, on January 19, they had assaulted their neighbour and his wife, who received six stitches on her head.

They had also made casteist remarks against the couple, according to the FIR.

The complainant alleged that the accused women in connivance with the area councillor had threatened them to influence the police to implicate them in false cases.
