Youth disabled in road accident gets Rs 13 lakh compensation

A Motor Accident Claims Tribunal here has awarded over Rs 13 lakh to a 28-year-old youth who suffered 30 per cent disability and memory impairment after being hit by a rashly driven motorcycle in 2011.

MACT Presiding Officer(PO) Ravinder Bedi directed ICICI Lombard General Insurance Company Ltd, with which the bike was insured, to pay Rs 13,68,679 to Delhi resident Sumit Kumar Singh, who was standing at a bus stand here when he got hit.

While awarding the compensation, the tribunal relied on medical reports of the victim and noted that the accused motorcycle rider did not appear before it to defend himself.
 

"The issue thus stands decided in favour of petitioner holding that the accident was a result of negligent driving by motocycle rider," it said.

"I assess that due to the disabilities sustained, his capacity has been considerably reduced, restricting him even from carrying his normal daily chores. Adding to this is the suffering on account of his substantial impairment in memory caused by the accident," the PO said.

As per the petition filed by Kumar, on the evening of October 24,2011 he was standing at a bus stop in Nirman Vihar here when a rashly and negligently driven motorcycle hit him.

He sustained grievous injuries and was taken to Lok Nayak hospital where he underwent treatment. Kumar approached the tribunal claiming a compensation of Rs 60 lakh for the disabilities suffered by him.

The accused bike rider did not appear before the tribunal and was proceeded ex-parte. The insurance company, too, did not deny the accident.
