Special Judge Narinder Kumar sentenced Delhi resident Rakesh after convicting him under various sections of the Narcotic Drugs and Psychotropic Substances (NDPS) Act for possessing the drug.
"The offence proved against the accused (Rakesh) is under section 21 (b) of NDPS Act. The convict is first-time offender and he kept in his possession only 10 grams of heroin. He is hereby sentenced to undergo rigorous imprisonment for four months," said the court and also imposed Rs 500 as fine.
The police had arrested Rakesh on February 2, 2011 on suspicion as he tried to flee after seeing a police patrol team.
Praying for leniency on the point of sentence, the counsel for Rakesh had contended that he had been falsely implicated in the present case and was picked up by the police from a tea stall in Central Delhi.
The court, however, convicted him saying "the prosecution has fully established its case against Rakesh that on February 4, 2011 when apprehended in the area of Nabi Karim, he was found in possession of powdery substance - 10 grams of heroin, and thereby, he made himself liable for an offence.
