Youth gets five years jail for sexually assaulting minor

A 21-year-old youth has been sentenced to five years' rigorous imprisonment by a Delhi court for sexually assaulting a six-year-old girl.

The court awarded the jail term to Rohit Saini, a resident of Sarai Rohilla here, after holding him guilty under the provisions of the Protection of Children from Sexual Offences (POCSO) Act and the IPC.

"I hereby sentence convict Saini to rigorous imprisonment for a period of five years and a fine of Rs 1000 for the offence punishable under Section 10(aggravated sexual assault) POCSO Act, 2012," Additional Sessions Judge Pawan Kumar Jain said.

While convicting Saini, the judge said, "I am of the considered opinion that prosecution has succeeded to bring home the guilt of accused beyond the shadow of all reasonable doubts for the offence punishable under POCSO Act and under Section 363 (kidnapping)/ 506 (criminal intimidation) of the IPC, thus, I hereby hold accused Saini guilty thereunder."
 

The judge said that since the victim was below 12 years of age, Saini's act amounted to "aggravated sexual assault" under the POCSO Act.

"Prosecution has established beyond all reasonable doubts that accused had taken the victim to the nearby house and thereafter, he had sexually assaulted the victim as defined under the Act," the court said.

A complaint was lodged by the grand mother of the minor on August 27, 2013 that Saini had taken the victim to a nearby house at Padam Nagar in Sarai Rohilla and sexually assaulted her.

The woman, who had gone to the bus stop to fetch the child, came to know from neighbours that they had seen Saini taking away the minor with him to a nearby house, police said.
