Youth gets Rs 12.67 lakh as compensation for 19% disability

While holding that the driver of the offending car was driving it negligently, the Motor Accident Claim Tribunal's presiding officer B S Chumbak directed National Insurance Company Ltd, with which the car was insured, to pay the sum to victim Rishi Sharma.

"I am of the considered view that ... Rishi succeeded in proving that on May 4, 2010 an accident had taken place due to rash and negligent driving of offending vehicle," the tribunal judge said.

"I, accordingly, grant a compensation to the tune of Rs 12.67 to Rishi with interest at the rate of 7.5 percent from the date of filing of the petition...." it said, adding the pain and suffering cannot be measured in money.

 

Rishi, employed with Times Business Solutions Pvt Ltd, had moved the tribunal alleging that while he was returning from his office in Noida on his two-wheeler in May 2010, a car, driven in a rash and negligent manner, hit him from back.

He had said as a result of the impact he fell down on the road and sustained grievous injuries, resulting in 19 percent of permanent disability in his right lower limb.
