Additional Sessions judge (ASJ) Ravinder Dudeja ordered jail term for Delhi resident Rambir after holding him guilty of raping the 18-year-old girl after kidnapping her from roadside in East Delhi where she was waiting for her office cab.
The court convicted Rambir, rejecting his contention that the girl was friendly with him and lodged a false case of rape against him following some quarrel with one of his friends.
"It is inconceivable that an unmarried girl would go to the extent of staking her reputation and future in order to falsely set up a case of rape on the accused merely on account of a quarrel with his friend.
"In our tradition-bound non-permissive society, a girl is extremely reluctant even to admit that any incident which is likely to reflect on her chastity had occurred. She would be conscious of the danger of being ostracised by the society and when in the face of these factors the crime is brought to light, there is inbuilt assurance that the charge is genuine rather than fabricated," the judge said.
"The testimony of prosecutrix (girl) is unflinching, consistent and infallible and inspires confidence of the court to believe her version regarding the rape committed by accused," the court said, while convicting Rambir.
While the case against Rambir's two juvenile friends is being adjudicated separately by the Juvenile Justice Board, the fourth accused is yet to be arrested and has been declared proclaimed offender. (More)
