For an offence that entails up to life sentence on conviction, the court awarded a milder punishment to the convict saying he was a young boy and stern punishment would "be prejudicial to his entire life."
"The mitigating factors are that the convict is a young boy aged 22 years and has no record of previous conviction and any harsh view at this stage would be prejudicial to his entire life. In view of the above, a lenient view is taken against the convict," said Additional Sessions Judge Kamini Lau, while sentencing Delhi youth Rahul.
The court also imposed a fine of Rs 12,000 on him, besides holding him guilty under the Arms Act.
According to the police, the incident had taken place in December 2007 when victim Rajneesh, a property dealer, had left his house to make payment for a plot while accused Rahul along with his nephew, who are the residents of same village, sat in his car.
When they reached outside the village, Rahul, who was sitting just behind the victim in the car, fired at his head and they fled leaving Rajneesh behind, it said.
Police said injured Rajneesh then made a call to his friend who took him to the hospital.
The court convicted Rahul on victim's testimony.
