Youth jailed for five yrs for murderous attack on neighbour

A 25-year-old youth has been sent to five years in jail by a Delhi court for attempting to kill his neighbour who lost an eye in the attack and died within a few days during treatment.

Additional Sessions Judge Vijay Kumar Dahiya handed down the jail term to Rahul Kharab, a resident of Dwarka area, for trying to kill his neighbour Aakash in a fight due to previous enmity.

The court also imposed a fine of Rs 2,000 on the convict.

"I am of the opinion that prosecution has been successful in proving that the accused had inflicted injuries on the body of the deceased which are dangerous in nature.... So the accused is hereby held guilty for the commission of offence punishable under section 307 IPC (attempt to murder)," the judge said.
 

The prosecution had claimed that earlier also, the accused had a fight with other family members of the victim.

"Aakash was having an enmity towards the family of the victim. He had beaten one of the family members of Aakash about one-and-a-half months prior to the incident," the prosecution said, adding that Kharab had also threatened to kill another family member of the victim.

According to police, Kharab had attacked Aakash by hitting his head with an iron rod on February 21, 2012 in Dwarka. However, the accused fled rom the spot after he saw the victim's brother coming.

They said that the injuries were dangerous and Aakash lost an eye in the attack. Later on, he succumbed to his injuries while he was being treated at AIIMS Trauma Center.

Kharab was arrested by the police on February 22, 2012.
