The Supreme Court has said that the right to property is a constitutional right and an individual cannot be deprived of his property without him being paid adequate compensation in accordance with the law.
A bench of justices B R Gavai and K V Viswanathan said the right to property ceased to be a fundamental right due to the Constitution (Forty-Fourth Amendment) Act, 1978, however, it continues to be a human right in a welfare state and a constitutional right under Article 300-A of the Constitution.
Article 300-A of the Constitution provides that no person shall be deprived of his property, save by authority of law.
The apex court delivered its verdict on Thursday on an appeal challenging a November 2022 judgement of the Karnataka High Court in a matter pertaining to land acquisition for the Bengaluru-Mysuru Infrastructure Corridor Project (BMICP).

The launch of two satellites for the space docking experiment (SpaDeX) also marked a first for the industry, which built the two spacecraft on their own under guidance from the Indian Space Research Organisation (ISRO) engineers.
The two satellites -- SDX01 (chaser) and SDX02 (target) -- each weighing 220 kg were integrated and tested by Ananth Technologies Limited (ATL), which has been associated with a number of ISRO projects for the past several years.
"So far, large satellites have not been realised in the industry by themselves. This is the first time that the two satellites have been integrated and tested in the industry," said U R Rao Satellite Centre (URSC) Director M Shankaran after the two satellites were placed in a 476 km circular orbit by the Polar Satellite Launch Vehicle (PSLV-C60) on Monday night.
Shankaran described the launch of the two satellites a trailblazer for the industry.

The output of eight key infrastructure sectors slowed down to 4.3 per cent in November 2024 against 7.9 per cent growth registered a year ago, according to official data released on Tuesday.
On a monthly basis, the production growth of these sectors was higher than the 3.7 per cent expansion recorded in October 2024.
In November, production of crude oil and natural gas contracted.
The production growth of coal, refinery products, fertiliser, steel, and electricity moderated to 7.5 per cent, 2.9 per cent, 2 per cent, 4.8 per cent, and 3.8 per cent, respectively, against 10.9 per cent, 12.4 per cent, 3.3 per cent, 9.7 per cent and 5.8 per cent in November last year.
However, cement output rose to 13 per cent in the month under review.
The growth of core sectors -- coal, crude oil, natural gas, refinery products, fertiliser, steel, cement and electricity -- was 4.2 per cent during April-November this fiscal. It was 8.7 per cent in the same period last fiscal.
