Gujarat HC rules in favour of Wim Plast to sell air coolers

Symphony had filed a case claiming that Wim Plast's Cello air cooler models - Marvel, Wave and Tower - were similar to the registered designs of its Winter, Sumo and Diet models

Gujarat High Court on April 26 2016 set aside Gandhinagar District Court’s order restraining Wimplast Ltd from selling its air cooler models namely Tower-25, Tower-50, Wave and Marvel after Symphony filed a case against Wim Plast.
 
Symphony Limited had filed a case against Wim Plast, a part of the Cello group, claiming that Wim Plast’s Cello air cooler models - Marvel, Wave and Tower – were similar to the registered designs of Symphony’s Winter, Sumo and Diet models. Following this, the Gandhinagar District Court granted a stay order against Wim Plast Limited for selling Symphony lookalike air coolers.
 
  Now, the Gujarat High Court has set aside the District Court’s order. “In view of above, Wim Plast Ltd can now freely sell and market their all air-cooler products,” said Wim Plast in a BSE filing today.
