The Bombay High Court on Friday directed the police to file a detailed affidavit in response to the petition of advertising firm director Bhavesh Bhinde, arrested in the Ghatkopar hoarding collapse case. Bhinde has sought that the FIR registered against him be quashed claiming that the hoarding collapse, which killed 17 persons, was an act of God and he is released on interim bail pending hearing of the plea. He has been booked for culpable homicide not amounting to murder. A division bench of Justices Bharati Dangre and Manjusha said the plea also raises the contention of illegal arrest as the mandatory notice under section 41A of the Code of Criminal Procedure was not issued to the accused first. The bench said the police will have to clarify their stand on this as several judgments say that illegal detention necessitates immediate release. The government on Monday asked all advertisers and advertising agencies to submit a self-declaration certificate making it clear that the advertisement does not contain misleading claims and adheres to regulatory guidelines. The self-declaration has to be submitted for all new print, digital, television and radio advertisements as required by a Supreme Court directive issued last month. The Supreme Court directive is a step towards ensuring transparency, consumer protection, and responsible advertising practices, a statement by the Information and Broadcasting Ministry said. The self-declaration certificate has to be uploaded on the Broadcast Seva Portal in case of TV and radio advertisements, and on the Press Council of India website for print, digital and internet advertisements, it added. A Mumbai court on Sunday extended till May 29 the police custody of Bhavesh Bhinde, director of the advertising firm which had installed a hoarding that collapsed in Ghatkopar area here and claimed 17 lives. M/S Ego Media Pvt Ltd, the advertising firm of Bhinde, managed the giant hoarding that collapsed on a petrol pump during a dust storm and rains on May 13. As Bhinde absconded after the incident, police registered a case against him on the charge of culpable homicide not amounting to murder under section 304 of the Indian Penal Code. He was arrested in Udaipur, Rajasthan, on May 16 and brought to the city. Bhinde was subsequently remanded in police custody till May 26. On Sunday, the crime branch, which is probing the case, produced Bhinde before the metropolitan magistrate court at the end of his previous custody. Cultural diversity is missing from the country's advertising, a report by the industry's self-regulatory body ASCI and a UN body said on Tuesday. The report said that less than one per cent of promotional campaigns feature persons belonging to lesbian, gay, bisexual, transgender, queer and intersex (LGBTQI) community as well as disabled, while only 4 per cent campaigns show people aged above 65. The study by Kantar on behalf of Advertising Standards Council of India (ASCI) and UN Women Convened Unstereotype Alliance scrutinised over 261 ads in 13 languages, and mapped them on dimensions of age, gender, sexual orientation, race/ethnicity, physical appearance, social class, disabilities, and religion. The Advertising Standards Council of India (ASCI) on Tuesday announced a tie-up with the Central Consumer Protection Authority (CCPA) to strengthen regulation around misleading ads. The CCPA has requested ASCI to forward any advertisement that is non-compliant with the ASCI Code and could potentially violate the Consumer Protection Act, 2019, along with its accompanying guidelines, to the CCPA for appropriate action, a statement said. "With similar objectives, CCPA and ASCI can work in complementary ways to ensure that any infringements are addressed effectively. New challenges are being created by digital advertising, and keeping pace demands a collaborative approach with like-minded bodies," Department of Consumer Affairs secretary Rohit Kumar Singh said.
