Coldplay concert: HC dismisses PIL seeking rule against black marketing

The Bombay High Court on Friday dismissed a plea seeking guidelines to curb black marketing and ticket scalping at major events in the backdrop of the alleged foul play in the ticket sale process for British band Coldplay's concert in Navi Mumbai this month. A division bench of Chief Justice D K Upadhyaya and Justice Amit Borkar said the issues raised in the petition pertain to the legislative domain, and hence, the court cannot interfere. "This is a legislative and executive decision. The court cannot interfere. The government is at liberty to formulate legislation addressing the concerns raised in the petition," the court said. The bench said that in the absence of a clear statutory framework mandating the reliefs sought in the petition, it cannot direct legislation to be enacted or laws to be amended in a particular manner. Century Mill land dispute: SC sets aside 2022 Bombay HC verdict against BMC

In a significant judgment, the Supreme Court has overturned a verdict directing the Brihanmumbai Municipal Corporation (BMC) to transfer the title of five acres land in Worli, Mumbai, to Century Textiles and Industries Ltd, now known as Aditya Birla Real Estate Limited. A bench comprising Justices Vikram Nath and Prasanna B Varale passed the judgment on January 7 while ruling in favour of the BMC and dismissing the plea of Century Textiles. Setting aside the Bombay High Court's verdict, the bench held the civic body was neither legally obligated to convey the land nor at fault for not executing the deed. HC rejects plea against Adani power contract, fines petitioner Rs 50K

The Bombay High Court on Monday dismissed a petition challenging a contract awarded by the Maharashtra government to Adani Group for supply of renewable and thermal power electricity, noting the plea was "unsubstantiated and reckless". A division bench of Chief Justice D K Upadhyaya and Justice Amit Borkar also imposed a cost of Rs 50,000 on the petitioner - Shriraj Nageshwar Aepurwar - for the vague petition. Aepurwar alleged the contract awarded to the Adani Group for the supply of 6,600 megawatts of renewable and thermal power was a violation of the petitioner's fundamental right to have access to fair electricity supply at a reasonable rate. The Bombay High Court on Saturday directed the Maharashtra government to submit details of the expenditure incurred by it as well as budgetary allocation for medical infrastructure in the state. The Bombay High Court on Thursday sought details from the city police of the probe into a case registered against NCP leader Nawab Malik under the Atrocities Act on a complaint of IRS officer Sameer Wankhede. Proceedings transfer from judicial officer not on apprehension of bias: HC

The Bombay High Court has said transfer of proceedings from a judicial officer cannot be done on mere allegation by one party, and dismissed a petition of the Lilavati Hospital's trust founder alleging bias against the Charity Commissioner. A single bench of Justice Sharmila Deshmukh last month refused to transfer the proceedings pertaining to a dispute between the trustees from the Charity Commissioner to any other judicial officer, noting there was no reasonable apprehension of bias or prejudice. The HC said passing of an adverse order cannot be the foundation for seeking transfer of proceedings. "It is necessary to ensure for securing the ends of justice that a mere allegation is differentiated from an apprehension and what is required is a reasonable apprehension. An absence of congenial atmosphere cannot be a ground for transfer," it said. The Enforcement Directorate has issued a fresh circular directing its officials or investigating officers (IOs) to not question people called on summons at "unearthly" hours and not keep them waiting for hours at their office. The technical circular was issued on October 11 after the Bombay High Court directed the federal agency to issue directives in this context as it took up the petition of a person who was summoned by the ED and "detained overnight and interrogated." The HC found that the 64-year-old petitioner was summoned to the ED office for questioning and was kept waiting post mid-night. Recording of his statement, at unearthly hours, "definitely results in deprivation of a person's sleep, basic human right of a individual", it said. The court said it "disapproved" of such a practice by the agency and directed it to issue a circular or directive to its IOs regarding timing and recording of statement of people following issuance of summons under section 50 of the Prevention

Former DU professor G N Saibaba passes away due to health complications

Former Delhi University professor G N Saibaba died at a state-run hospital here due to health-related complications on Saturday, merely seven months after he was acquitted in a case of alleged links with Maoists after 10 years in prison. Saibaba, who was in his 50s, breathed his last at around 9 pm, an official said. He died at due to gall bladder infection and other complications. The Bombay High Court in March this year acquitted Saibaba in an alleged Maoist links case, noting the prosecution failed to prove the case against him.

Badlapur case: HC directs submission of report on custodial death by Nov 18

The Bombay High Court on Thursday directed the magistrate to submit by November 18 an inquiry report into the custodial death of Akshay Shinde, the accused in the Badlapur school sexual assault case. A division bench of Justices Revati Mohite Dere and Prithviraj Chavan gave this direction, and also ordered that all evidence related to the case be collected, preserved and checked by forensic experts. The bench also emphasized the police to include strong forensic evidence in its probe into the incident where the accused was killed in a police shoot-out. The law mandates that every custodial death has to be inquired into by a magistrate. Advocate General Birendra Saraf said all relevant documents have been forwarded to the magistrate for inquiry. The court said the magistrate shall commence the inquiry and hear all parties concerned. "The report shall be placed before us on November 18.
