SC upholds Ajay Mishra's acquittal in Lakhimpur Kheri murder case

The Supreme Court has upheld an order of the Allahabad High Court that dismissed an appeal filed by the Uttar Pradesh government in 2004 against Union minister Ajay Mishra's acquittal in a murder case. The case pertains to the killing of Prabhat Gupta in Lakhimpur Kheri district of Uttar Pradesh in 2000. A top court bench of Justices Bela M Trivedi and Pankaj Mithal said it was not inclined to interfere with the concurrent findings of facts recorded by the Lucknow bench of the high court and the trial court. "Having heard the senior counsel, Kapil Sibal, appearing for the petitioner, at length and after carefully perusing the material placed on record, we are not inclined to interfere with the concurrent findings of facts recorded by the two courts. Hence, the special leave petitions are dismissed," the bench said in its order passed on January 8. The trial court had acquitted Mishra in the case in 2004, after which the state government challenged the decision in the high court. T

Crimes against women, children rise in Bengaluru in 2023, show police data

Bengaluru has witnessed a significant increase in crime against women in 2023 with the city police registering 3,260 cases including 1,135 related to molestation, shows official data. The police attributed the rise to enhanced awareness, initiatives of filing suo moto cases and registration of e-FIRs, among other factors. In 2023, the city also witnessed an increase in other crimes as compared to the previous two years with the police registering 205 cases of murder, 153 cases of chain snatching, 673 robbery cases, 1,692 cases of house thefts and 5,909 cases of motor vehicle thefts, according to the data shared by the police. According to the data, the city police registered 2020 FIRs related to crime against women in 2021, 2630 FIRs in 2022 and 3,260 FIRs in 2023. SP leader Azam Khan, son acquitted in 2019 attempt to murder case

A special sessions court here on Saturday acquitted Samajwadi Party leader Azam Khan and his son Abdullah Azam in a 2019 attempt to murder case while upholding their seven-year sentence in a four-year-old forgery case. Special Sessions Judge Vijay Kumar granted Azam Khan, his son and two other relatives relief in the attempt to murder case for lack of evidence, Senior Prosecution Officer Amarnath Tiwari said. It was alleged in the case that Azam Khan, Abdullah Azam and two of their relatives had threatened a neighbour to vacate a plot of land, following which police had filed a charge sheet against them under sections of the IPC, including 307 (attempt to murder) and 323 (causing grievous hurt), Tiwari added. 2022 saw over 31% rise in offences promoting enmity between groups: NCRB

More than 1,500 cases were registered under IPC section 153A that penalises promoting enmity between different groups, including offences of hate speech, across India in 2022, a 31.25 per cent increase from 2021 but a 15.57 per cent decline from 2020, according to the NCRB. Last year, the maximum of these 1,523 cases were lodged in Uttar Pradesh (217) followed by Rajasthan (191), Maharashtra (178), Tamil Nadu (146), Telangana (119), Andhra Pradesh (109), and Madhya Pradesh (108), the data showed. The National Crime Records Bureau (NCRB), which functions under the Union Ministry of Home Affairs, is tasked with collection and analysis of crime data from all states and union territories, the figures of which are published annually in its report. In 2022, nine states registered over 100 cases under IPC sections 153A, while in 2021 there were just two states - Andhra Pradesh and Uttar Pradesh - with such offences in three-digits. Parliamentary panel seeks robust safeguards for technology in legal process

A parliamentary panel, which examined the three proposed criminal laws, has hailed the move to enhance the use of technology in legal proceedings but said the adoption of electronic means for communication and trials should proceed only after the establishment of robust safeguards. The Parliamentary Standing Committee on Home Affairs, headed by BJP MP Brij Lal, also said enabling online or electronic FIR registration is a positive step forward but these should be allowed only through modes specified by the state. "The committee notes that the Sanhita provides for acceptance of trials in electronic mode as provided in 'Clause 532' wherein all trials, inquiries, and proceedings may be held in electronic mode by production of electronic communication devices, likely to contain digital evidence, for investigation, inquiry, or trial," the panel noted. 5 ex-PFI activists booked under UAPA for involvement in unlawful activities

A case has been registered against five activists of the now-banned Popular Front of India (PFI) for their alleged involvement in unlawful activities after the raids conducted in their premises on October 13.
